Scope and Content Note

This Sub-Group consists of records created or received by the University Attorney and General Counsel to the Board of Curators. Among records included in this Sub-Group are correspondence, legal briefs, legal opinions (by the University Attorney and other members of the Law School faculty as well as the General Counsel), records of bequests to the University, records of defense of the University in lawsuits, documents relating to the establishment of trusts and foundations, and contracts between MU and other universities and corporations. Also included are records pertaining to such matters as student loans, wage rates, book and patent royalties, investment of University funds, group insurance plans, Internal Revenue Service rulings, fraternity leases, faculty retirement plans, and the student health service.

Historical Note:

The position of University Attorney was held by a member of the MU School of Law faculty who functioned as a legal advisor to the Board of Curators and the University President until 1954. In 1954, the Office of General Counsel to the Board of Curators, a full time position, was created.

Series Descriptions:

Series 1. - UW:3/4/1 (A75-53)
This Series contains records of the MU University Attorney (1923-1955). This legal advisor to the Board of Curators and University President was selected from faculty members of the MU School of Law. Faculty who held this position have included Orville M. Barnett (1921-1935), Lee Carl Overstreet (1936-1943 and 1948-1954), and Orrin B. Evans (1943-1946). Among records included in this Series are correspondence, legal briefs, legal opinions offered by the University Attorney and other members of the Law School faculty, records of bequests to the University, records of defense of the University in lawsuits, documents relating to the establishment of trusts and foundations, and contracts between the UM System and other universities and corporations. The topics covered include the following legal cases: Gaines, Bell, and Bluford, and information regarding insurance coverage, patents, the Missouri Research Foundation, J C Penney's Foremost Guernsey Herds, and taxation.

Series 2. - UW:3/3/1
This Series contains correspondence from the Office of the General Counsel to the Board of Curators (1954-1967). Topics of this correspondence concern a broad spectrum of the University's business and legal affairs, such as student loan funding, family scholarships, contracts for the harvesting of timber on University lands, estates willed to the University, MU physicians' liability for malpractice, royalties from books and patents by faculty members, bond issues, tax issues, the Noyes Trust, vending machines on campus, athletic contracts, traffic violations on campus, investment of the Seminary Fund, group insurance plans, the student health service, transfer of property from the University of Kansas City to the University of Missouri-Kansas City, and faculty retirement plans.

Series 3. - UW:3/5/NP (A97-25)
This Series contains records of the Office of the General Counsel to the Board of Curators (1986-1991). Included are investigation files pertaining to an investigation of MU's Intercollegiate Athletics program by the National Collegiate Athletics Association. Among the materials in this Series are also some estate documents and travel expense records.

Series 4. - UW:3/5/1 (A23-80)
This Series contains records of the Office of the General Counsel, (ca. 1967). The records pertain to the Office's Legal Deparmtment and consist of a brief history, names of staff, the organization of the department, basic legal propositions, a reading list, an organizational chart of the University of Missouri, and a photograph of the Board of Curators from November 1967.

Restrictions Note: The Archives of the University of Missouri-Columbia is required by law and Board of Curator's policy to restrict access to some files and information. Student records are held as confidential under the Federal Educational Rights and Privacy Act of 1974 and by University policy. Faculty promotion and tenure records and Academic Personnel files are restricted for 75 years, or the lifetime of the individual. All grievance, disciplinary, and medical records are treated as confidential files. Consultations with legal counsel, both in-house and external, are protected by the attorney/client privilege and will not be released.
